Who must notify?

If you're a person conducting a business or undertaking (PCBU) planning to use, store or handle hazardous chemicals above manifest quantities at your place of work, you must notify us.

When must I notify?

You must notify us immediately after you know that hazardous chemicals above manifest quantities will be used, handled or stored at your place of work, or at least 14 days before the first use, handling or storage (whichever is earlier).

Other requirements

You must include a copy of your manifest of hazardous chemicals when you submit your notification. This document is required to be kept in a red HAZMAT box at the front entrance of your place of work for the purpose of communicating hazard information to emergency services in the event of an emergency response. The content of your manifest must comply with Schedule 12 of the WHS Regulation. In addition to notifying us using Form 73, you must also send a copy of your emergency plan to Queensland Fire and Emergency Services. Refer to the Queensland Fire and Emergency Services website for more information on emergency planning including the email address to send your emergency plan and where to position your HAZMAT box.

Re-notification for a significant change

You must submit a re-notification if there's a significant change in the risk of using, handling or storing hazardous chemicals at your place of work.

You must re-notify us immediately after you know that a significant change will happen, or at least 14 days before that change (whichever is earlier).

You must re-notify us using Form 73 – Notification of a manifest quantity workplace (PDF, 2.51 MB).

A significant change is likely to influence the details on your manifest of hazardous chemicals and the way emergency services respond to an incident. A significant change could include:

• introducing or removing a storage area that exceeds a placard quantity
• a substantial permanent change (for example ± 20 per cent) in the quantity of a placarded storage area, based on the largest quantity likely to be kept
• introducing new types of hazard classes and/or categories
• installing a new storage and handling system – for example, a bulk fuel tank, or a modified freight container for storing flammable liquids, or expanding the capacity of an existing ammonia based refrigeration system
• removing a storage and handling system – for example, decommissioning an underground fuel tank, or removing a chlorine-gas dosing system or LPG tank
• no longer using, handling or storing hazardous chemicals.

Who must notify?

If you're the operator of a facility storing or handling Schedule 15 chemicals in quantities that may exceed 10 per cent of the prescribed quantity, you must notify us.

When must I notify?

You must notify us as soon as practicable after you become aware of the circumstances that require you to notify us. This should be no more than three months.

You can apply to us for a longer period to notify, if there is a reasonable excuse for a delayed notification.

Re-notification

You must re-notify us if the quantity of materials present is to be increased or if the operator of the facility has changed.

Who must notify?

If you're a pipeline builder intending to build a pipeline to transfer hazardous chemicals that will cross into a public place, you must notify us.

If you're the operator of an existing hazardous chemicals pipeline passing through a public place, you must also notify us. Your notification must give details of the supplier, receiver and classification of the hazardous chemicals transferred through the pipeline.

When is a tank considered abandoned?

An underground, partially underground or fully mounded tank intended to store flammable gas or flammable liquid is considered abandoned if it:

• hasn't been used in the past two years
• won't be used in the future.

Who must notify?

If you're a person conducting a business or undertaking (PCBU) who controls or manages an abandoned underground, partially underground or fully mounded tank intended to store flammable gas or flammable liquid, you must notify us.

When must I notify?

You must notify us as soon as practicable after the tank is abandoned.
