Employer obligations regarding licence holder training

A person conducting a business or undertaking (PCBU) must not direct or allow a worker to carry out high risk work (HRW) unless they sight evidence that the worker either:

  • holds the relevant HRW licence for that work
  • is undertaking the training course and is under supervision of a suitably licensed person
  • has applied for the relevant licence.

Note: a person is not required to hold the appropriate HRW licence when loading plant onto, or unloading plant from, the vehicle or equipment used to move the plant. Penalties may occur for PCBUs that encourage, induce or cause a licence holder to carry out licensed work other than the way the licence holder was taught.
