Background

Worker was injured when she was helping a patient use the toilet at a nursing home. The patient's wheelchair ran over her foot.

Judgement

The Magistrate accepted that the care plan for the patient (which provided how staff were to move her) was not clearly communicated and that this breach caused the injury.

Plaintiff won and was awarded $143 000 clear of the refund.
