Background

The worker injured his knee when he was moving furniture – he knocked a small footstool, stumbled and felt pain in his knee. The injured worker (who was taken to be the one in charge of the lift) looked behind him before he began the move but he didn't notice the footstool.

Judgement

The Court did not accept that the employer needed to implement a more complex and rigorous system that what actually occurred.

Plaintiff's claim dismissed.
