Case 35

The worker made an Application for Compensation for injuries she allegedly sustained to her left ankle whilst working as a stable hand on 10 May 2011. The claim was accepted and benefits were paid from 10 May 2011 to 2 October 2011.

On 3 October 2011 the worker was seen working at Subway. The worker was then asked whether she had undertaken any form of work since she sustained her injury. The worker denied any form of work.

Inquiries with Subway confirmed that the worker had commenced employment in the week commencing 31 August 2011 as a sandwich artist.

On 12 November 2012 the worker pleaded guilty to one count of fraud and one count of providing false and misleading information. She was fined $1,000 and ordered to pay restitution of $4,028.
