Case 3

The worker suffered an injury to her wrist on 28 December 2007 in the course of her employment as a cleaner and compensation was paid from 12 February 2008 to 05 December 2008.

During the period 1 May 2008 to 23 August 2008 the worker returned to work as a cleaner and was also running her own cleaning business and failed to notify WorkCover.

After a two day trial the worker was found guilty of one charge of fraud and two charges of knowingly making false and/or misleading statements to WorkCover. The worker was sentenced to a six month term of imprisonment, wholly suspended for an operational period of two years and ordered to pay $50,382 in restitution and costs with a conviction recorded.
