Facts

The defendant made an application for compensation to WorkCover. WorkCover decided not to accept the defendant’s claim on the basis that the medical evidence did not support the defendant having sustained an injury caused by their employment.

The defendant applied for a review of that decision by the Workers’ Compensation Regulator. In support of their review application, the defendant provided a letter, purportedly written by the defendant’s doctor. The letter was not in fact written or signed by the doctor, and the defendant had fabricated the letter in an attempt to influence the review decision in their favour.
