Terms and conditions of entry

  1. These 'terms and conditions of entry' apply to all entrants and categories for the Safe Work and Return Work Awards 2017. By participating in the awards, entrants shall be deemed to agree to abide by these terms and conditions and all other rules of the awards.
  2. Each entry must be made in writing and submitted electronically via the Safe Work and Return to Work Awards online entry portal available at www.worksafe.qld.gov.au. Each entry must include a completed official entry form. Instructions on how to enter the awards are also available online at www.worksafe.qld.gov.au. This content, the instructions on how to enter the awards and any other details about the awards contained within the promotional material all form part of the terms and conditions of entry.
  3. The Safe Work and Return to Work Awards will be administered by the Queensland Government.
  4. Entry to the Safe Work and Return to Work Awards is open to individuals, associations, partnerships, companies and other organisations operating within Queensland. However, the Queensland Government reserves the right to either allow or disallow any entrant for any reason at its complete discretion.
  5. In order to be eligible to enter the Safe Work and Return to Work Awards, (including, in the case of a corporate entrant, related bodies corporate or associated entities within the meaning of the Corporations Act 2001 (Cth) and including directors of a corporate entrant who were also directors of such related or associated entities within the two years prior to the date of issuing the awards) must not, within the two years prior to the date of issuing the awards, have had a prosecutable workplace fatality; i.e. a workplace fatality which is currently the subject of investigation or prosecution by the Queensland Government.
  6. Entries to the awards open at 9:00am on 19 April 2017 and all entries must be received by midnight on 23 June 2017. For reasons of fairness, late entries will not be accepted.
  7. Entries dealing with scientific, medical or technical achievements should be accompanied by a summary in plain English or 'lay' terms.
  8. Judges will have complete discretion in assessing entries, applying the judging criteria, conditions of entry and determining the awards.
  9. The decision of the judges is final and no correspondence will be entered into.
  10. The assessment, conduct and results of the awards will not create any legal obligations between entrants and the Queensland Government, the Crown in right of the State of Queensland or the Commonwealth.
  11. The Safe Work and Return to Work Awards judging panels reserve the right not to allocate an award in a particular category where, in their opinion, there are no entries of sufficient merit.
  12. The Safe Work and Return to Work Awards judging panels reserve the right to consider entries in suitable alternative categories at their discretion.
  13. If an entrant who is judged to be a winner is found to have failed to satisfy or abide by the terms and conditions of the Safe Work and Return to Work Awards, they shall not be entitled to the relevant award. As a consequence, the Queensland Government may award the relevant award to another entrant or choose not to award the award at all.
  14. Persons, sole traders or organisations submitting an entry to the awards must have all insurance/levies required by law, or otherwise appropriate, for the conduct of their day-to-day activities.
  15. The Queensland Government will not accept any responsibility or liability in respect of any lost entries.
  16. Entries and supporting material will not be returned to entrants.
  17. By entering the awards, each entrant warrants that its entry, including any designs and/or inventions, is the entrant's original work, that any intellectual property rights arising in connection with that entry vest in the entrant and that the entry does not interfere with any third party rights.
  18. Winning an award does not signify endorsement of a particular product or a particular health and safety or return to work practice by the Queensland Government.
  19. The Queensland Government reserves the right to decline to accept, or to disqualify, an entry at its absolute discretion, including but not limited to situations in which the entrant, or a related person or organisation, has breached or is under investigation for possible breaches of occupational health and safety or compensation laws (whether or not a prosecution is pending), or where the acceptance of the entry may otherwise be detrimental to the objectives of the Safe Work and Return to Work Awards or health and safety and compensation schemes.
  20. All entrants agree to allow officers of the Queensland Government to enter and inspect premises that are the subject of, or related to, an entry for the purposes of verifying the entry.
  21. The Queensland Government will ensure that there is no disclosure to any third party of any information provided by an entrant and marked 'confidential', except with the prior consent of that entrant or where such a disclosure is authorised or required by law.
  22. By entering the Safe Work and Return to Work Awards each entrant warrants that all information in its entry is true, accurate and complete. Entrants may be requested to provide further evidence to substantiate their entries and, if so requested, such evidence must be provided within the stipulated timeframe.
  23. All entrants authorise, subject to receipt of prior written notification, the Queensland Government to use the information contained in or related to entries (other than confidential information) for any purposes it sees fit including, but not necessarily limited to, promotional purposes which may include being published to the worksafe.qld.gov.au website.
  24. Without limiting the generality of clause 23, and subject to proper acknowledgement being given to the relevant entrant, all entrants authorise the Queensland Government to publish details of their entry, including (but not limited to) contact names, phone numbers and photos. The Queensland Government will not use the personal information of entrants for any other purpose without prior consent of the entrant, or unless authorised or required to do so by law.
  25. Entrants acknowledge that they may be required for presentations and media interviews in respect of their entry and agree to take all reasonable steps to make themselves available for, and actively participate in, such presentations or media interviews at the entrants own expense.
  26. All entrants authorise the Queensland Government to recommend that the product, method or service comprising their entry be adopted for use by any other individual or organisation.
  27. Safe Work and Return to Work Award 2016 winners are ineligible to enter this year's Safe Work and Return to Work Awards with the same or substantially the same initiative/solution/contribution.
  28. The Queensland Government, the Crown in right of State of Queensland, the Commonwealth and the officers, employees and agents of all the preceding do not accept any liability, however arising, including liability for negligence, for any accident, loss, injury or damage arising at any time out of or in connection with the Safe Work and Return to Work Awards except for any liability that cannot, by law, be excluded.
  29. Entrants who breach any of these 'conditions of entry' are subject to disqualification.
  30. The organisation its representatives and agents must acknowledge the Queensland Government in any promotional material or media they undertake regarding the Safe Work and Return to Work Awards 2017.
  31. The winner/s will be announced in October 2017 and notified by phone, email or mail to the number or addresses provided in the winning entrant's official entry form.
