A guide for workers on psychological injury claims and reasonable management action
Workers’ Compensation Regulatory Services has published a guide for workers on psychological injury claims and reasonable management action.
The factsheet is written in plain language and provides workers with a clear explanation of the reasonable management action exclusion at the time an injured worker makes their claim.
It explains to workers that to have a psychological injury claim accepted by their insurer, they must show:
- Psychological injury: That they are medically diagnosed with a psychological injury.
- Work-related: That their psychological injury arose out of, or in the context of, their employment.
- Significant factor: Their employment significantly contributed to their injury, or their injury happened while on a scheduled break or while travelling to or from work.
- Reasonable management action exclusion: Their injury was not caused by 'reasonable management action taken in a reasonable way'. This exclusion will not apply if the causes of an injury did not involve management action, or for first responders or other eligible workers diagnosed with post-traumatic stress disorder by a psychiatrist.

Workers' compensation information statements
Insurer-provided workers' compensation information statements start on 1 January 2025
Starting 1 January 2025, workers’ compensation insurers must provide an injured worker and their employer with an information statement about the workers' compensation scheme after a claim is lodged. Insurers can provide these statements in hardcopy or electronically (such as a link in an email).
The statements are designed to help workers and employers navigate the workers' compensation process and understand their rights and obligations in the scheme.

Changes to employer information statement requirements
Recent changes to the Workers' Compensation and Rehabilitation Act 2003 included requirements for employers to give an information statement approved by the Workers’ Compensation Regulator to workers before or as soon as practicable after the start of employment from 1 January 2025.
This statement has not been approved by the Workers' Compensation Regulator, meaning the requirements on employers will not apply.
