Workshop 2 background

The focus of this workshop was to start exploring possibilities for change in the existing common law process. The aim of these possibilities was to improve the experience of those involved in the process.

In these workshops, there were two main activities: working with seed concepts and generating new concepts.

The seed concepts were largely provocations or possibilities for future change. They were generated from either specific comments made by people in past workshops or directed towards specific themes that had emerged from the insights gathered so far.

Generating new concepts asked participants to come up with ideas (or other thoughts) working around a perception card of a person involved in the process as well as a single or a small number of insights. Participants were asked to come up with a concept for that person around the specific insight/s.

Whilst generating new ideas was the focus, we also used this activity to start to identify where people were making assumptions about a state or constraint. These assumptions, as well as the blind spots that were missed by the assumptions, are again revealing in what is important to people.

Post workshop actions

We created high level concept maps and consulted with plaintiff lawyers, panel lawyers and unions for their input.

Initiatives were then prioritised and are currently underway.
